TERMS OF SERVICE

By purchasing my services (art), you automatically agree to the following conditions.

Please read this entirely and carefully. I will refuse your commission if you do not agree to these terms, and blacklist you if you did not read my TOS before commissioning me.

Clients who have commissioned and/or received work before this TOS has gone into effect are still bound to its contents.

I request that anyone commissioning me stays patient and professional working with me. I struggle with mental health and burnout often, so please allow up to the maximum of 3 months completion time. You may ask for updates but please don't be pushy! If you ask too often within a few weeks and demand updates, I will cancel your commission and refund you.

Commissions are expected to take anywhere from one week to (at maximum) 3 months to complete. If there are any changes to the expected timeframe, I will let you know.

You, the client, may display my work on external sites as long as it is visibly credited and linked back to me.

You may not, however, upload or host my work in any gallery that is intended to display your own work only. (such as DeviantArt, Buzzly, Inkblot, etc.)

You may not claim my work as your own; if you do so, you will be blacklisted.

You may use your commissioned artwork freely (for avatars, backgrounds, etc.) as long as it is for personal use only.

You are not authorized to use my artwork or designs commercially.

You are not authorized to change, modify, or edit my works without my permission.

You are not authorized to trace over my artwork in any way, including the use of the artwork as a “base.”

You may use my artwork and style as inspiration or vague reference, as long as you are not tracing or copying the majority of the piece, including color palettes, poses, and stylistic elements. If color picking, do not use the entire palette.

I retain all copyright over my work, which includes the right to redistribute, reproduce, or use the image as a sample for sales or self-promotion unless otherwise agreed upon.

I will send you work in progress (WIP) pictures of your commission at the sketching, lining, coloring, and shading stages. Lineart edits will not be made in the coloring and shading stages, and large edits will not be made to the pose of the character once lineart work has begun.

I will do small adjustments (small sections of color, mistakes on my behalf, etc.) for your WIP commission for free throughout the process. I will allow 5 free changes for large adjustments (marking shapes, marking placement, color palettes etc.) but past those initial 5, each adjustment moving forward will cost 5 USD.

It is expected that you deposit 100% of the price upfront before I start. No exceptions unless otherwise discussed.

You must be 18 years of age to send payment. I will not accept payment from minors.

Nothing is ever intended by either me or the client, to be physically shipped to them.

I can refund 100% of the payment only if I have not started working on the piece. Once I start the sketch, there will be no refunds.

If I cancel a project, I will reimburse the lost fees and refund 100%.

When buying or receiving a design of mine, you may change/alter the design however you like, change the species, etc. but editing my original work is prohibited.

The design may be resold/traded/gifted; in the situation of reselling a design, it may not be resold for higher than the original price unless it has additional commissioned artwork.

Owners of my designs MUST have toyhou.se accounts and design profiles MUST be credited back to me (ottermeal).

Creating closed/open species based off my designs is prohibited.

You may not under any circumstance create NSFW content of my feral character designs. If you wish to do so, please make them anthro.

You may not color pick and copy the entire palettes or patterns of my designs and OCs. Being inspired is fine, but color picking several or more colors and patterns to use together will result in a blacklist.

Character reference sheets, mood boards, sample of poses / angles / expressions, any other relevant files or links.

Pose, expression, clothes, background color/gradient, etc.

The MAX turn around time for completion is 3 months, however I do my best to never take that long!

File delivery may be done through email, discord, or sta.sh

Depending on your character's design, there may be a complexity fee ranging from $5-10!
