General Illustration Policy

By sending a request for a commission, you have read and agreed to the following conditions by any means.

This agreement is between I, the Artist, and you, the Client, for work services performed on a project known as the Work. 

I, the Artist, have the right to refuse projects and requests according to my discernment and capabilities. 

I, the Artist, warrant that the Work will be my original work performed to the best of my ability. Artistic style is subject to minor changes as I improve and develop as an artist.

You, the Client, must first submit a request for the commission. Once I, the Artist, accepts the request, I will begin reaching out to the Client to finalize the price of the commission. 

After the price has been finalized, I will proceed onto thumbnail sketches of the Work. When the thumbnail is accepted, the Client will pay the Artist a down payment of 50% or 100% of the final price.

Once the down payment is received, I will then start on the commission, periodically checking in with the Client after every phase of the drawing process and/or revisions. The Client is free to check in at any time as well.

The completion of the Work requires 1 week at minimum, and may typically average 4 weeks to 2 months, depending on commission type, complexity, and workload of commissions. Deadlines and timelines will be adhered to in good faith but may not be possible sometimes. Note that each project may vary. Please plan your commissions accordingly.

There may be 3 major revision(s) before the rendering stage, not including mistakes made by the Artist. There may be 2 revisions after the rendering stage, but they can only be minor. 

Delivery of finished Work will be through Google Drive.

Communication will take place on either VGen or Twitter DMs throughout the entire project timeline. I will let you know if anything is causing delays or priority shifts in the project. I will typically respond quickly but may also take up to one week, which is usually in order to provide a better, more concrete, update.

Clients agree to provide all required art, references, information and assets before Work starts and during the process, or it can affect the timeline.

Clients agree to remain respectful and agree that communication channels I provide are for business and professional use only. Client and Artist will not for any reason digress from business discussion for the majority/duration of the project.

I retain original copyright and ownership of the Work, which includes but may not be limited to redistributing, reproducing, advertising, displaying the Work in my websites, social media and portfolios according to my discretion. I have rights to repurpose unused process work for future projects, personal or otherwise. 

The process will likely be posted on Twitter, Instagram, TikTok and/or streamed on YouTube unless Clients request otherwise before the project begins. A NDA or confidential commission status may be subject to a +$100 fee.

Clients are granted exclusive rights for personal use of the Work produced as agreed upon, which must not be transferred to any other parties. Personal use includes:

Social media profile pictures, signatures, layouts, themes, wallpapers, personal website display, social media posts, physical prints and products that are NOT for sale or distribution to any other party.

Clients may not at any time modify, edit, change the Work without permission from the Artist.

Clients may not claim Work as their own or anyone else’s and therefore must credit me as the Artist using my social tag @auverrr. 

Commercial means usage on streams, broadcast content, or any monetized work (including but not exclusive to: merchandise, monetized videos, music releases); and reselling rights means selling the Work to another party or another platform or on any platform. 

Any Work done or made available to the client must not be used for AI (Artificial Intelligence, Machine Learning, AI/ML Training, NFT, blockchain or any for profit platforms or purposes. Such usage is completely prohibited and may result in legal action taken.

Commercial content licenses require additional charges of 100% the total price. Merchandise/advertisement licenses require additional charges of 200% of the total price.

Clients can request cancellation and be partially to fully refunded if there is more than 2 days notice before Work starts. Once Work begins, refunds are NOT possible unless initiated by the Artist.

If for any unforeseen reason I cannot complete the Work or the Work is significantly delayed by 2 months past the deadline, I will take initiative to inform you and provide a partial refund if Work is done up to the coloring and partial rendering stage or full refund if the coloring stage is not finished.

I reserve the right to refuse to accept projects if it does not fit with my studio.

By commissioning, you confirm you are at least 18 and above or have a legal parent/guardian to agree to all of the terms of service as listed above.

The date for this agreement is upon the date in which the request is accepted.

Base prices apply to 1 character. Each extra character will be +70% of the base price.

Character reference sheets, mood boards, sample of poses / angles / expressions, any other relevant files or links.

Mood boards, descriptions, reference sheets for background or any other relevant files or links.

Rush order fees may apply. Note: If the illustration is too complex, I might not be able to accept the hard deadline and rush fee. Please consult me if your illustration falls in this category.

If there's any specific add-ons/ideas that haven't been mentioned in earlier sections.

Illustration

An illustration (Size: at least 3000 px in height and 300 dpi. File type: PNG) of your character(s) in full color, fully rendered.

Adding character: 70% base price per character. Maximum 5 characters.

Complex prop/character design/pose: $10 to $30 

No backgrounds/ Solid color or gradient/ Simple graphics: Free

3 free revisions before the rendering stage.

2 free revisions after the rendering stage. NO major revisions that drastically change the illustration at this stage.

After the request is accepted, I will go over the request with the client, finalize the price,  and get started on the thumbnails.

After getting the thumbnail approved, the client will send 50% or 100% down payment.

I will get started on the commission, checking in with the client after each phase of the work in progress, or when the client checks in.

Finished work will be sent by a Google Drive link through Twitter or VGen DMs.

TAT: 1 week to 2 months from when I START working on your commission.

Please provide clear references of what you want, preferably using a photo album like Google Drive or with a site like Toyhouse.

The commission will be in the style shown in the example. 

I have the rights to refuse the commission if I feel I am unfit for the job.
