General ToS

The principle of good faith applies to this ToS because of the nature of the service being offered.

"The client" or "you" means the person that commissions.

"The artist" or "me" means the person that works and delivers the comission final result/product.

Please use the payment method system that the website provides,

All payments and commissions include what will be called "small revisions",

Some examples of "small revisions" are (but not limited to):

3.- Adding a small intro and/or small outro to the song.

5.- Quick changes to the master levels (volume).

All progress will be informed to the client through "demos" or "rough sketches" to check if the song is what the client had in mind; before commiting to a song, the client will need to accept a "final demo" which will be pointed as such.

What does not qualify as a "small revision"?

Something that requires re doing an already completed track that was previously accepted by the client by accepting a "final demo".

A "new full demo", free of charge, may be offered by me if - 

 - good faith has been respected through the commission, communication and work process.

Demo and sketches will be send within a non-fatal 2 weeks window period that starts with the full upfront payment of the commission.

Final mastered song delivery will depend on the project and if there is a deadline for said song that was previously informed by the client.

The delivery will, probably most of the time, include:

1.- An "OST" version: which is a song file mastered at around -10 LUFS (for general multimedia use)

2.- A "BGM" version: which is a song file mastered at around -23 LUFS (for edition purposes);

An "unmastered" or "mix" version of the song can be included if the client asks for one beforehand.

Unless the commission includes a "buyout" rate added to it, the commission serves as a license to be freely use on the project that the song was commissioned for by the client; said project should be made known to me beforehand.

If the song will be used for a commercial project, royalties should be discussed beforehand.

Paying the "buyout" rate lets the client use the song for any type of project that's different from the one it was originally made for, be it commercial or non-commercial.

For example: if the song is being made for the OST of an specific game or project and the client wants to later use it as part of a different project or use it for advertisement purposes that could give some type of revenue to the client; the client will need to pay the buyout price for the song first.

Even if the delivery of a song includes an "OST" version of the song; this does not mean that you can sell it as part of a soundtrack without previously discussing the payment of royalties that come from the revenue of said soundtrack; royalties do not need to be discussed if the client already paid the "buyout" rate for the song.

If the "buyout" rate has not been paid but the client intends on using it on another project that the song was intended to be used in, a waiver of said buyout rate may be given by me if it's previously informed and discussed with me, the artist.

Because of the nature of the product (a digital product), 

Exceptions may apply if the product cannot be used for the intended medium it was made for if - 

 - its problems come from a technical nature, like if the song was delivered in another file format that was 

 by the client; in other words, mistakes and technical errors made by the artist, that have enough proof of said errors made by the artist, give the client the right to either ask for a refund or ask for the technical mistake to be corrected, free of charge.

The principle of good faith applies in it's entirety to refunds.

Any method that correctly stablishes a proper way of communication between the client and the artist 

 a correct way of letting me know of troubles and problems that may arise in regards to the policies pointed out in this "Terms of Service" text.

General ToS Mixing/Mastering

2.- A "dynamic" version of the song: which is a song file mastered at around -23 LUFS (for edition purposes);

For mixing purposes, the client should explain beforehand if STEMs are needed for future mastering process

A STEMs mastering process price is not included in a normal "mastering" process and should be discussed beforehand.

Full credits should be given as following:

Or in any way that basically gives me credit for the work done.

Character reference sheets, PSD for rigging, mood boards, sample of poses / angles / expressions, any other relevant files or links.

Pose, traits, multiple characters, add-ons, etc.

General Music Request

What plugins do I use through this process

The entire Music Production Suite 5 from Izotope (Neutron 4 Advanced / Ozone 10 Advanced / Nectar+ 3 / VocalSynth).

The entire IK Multimedia plugins made for mixing and audio processing (Mixbox / T-Racks 5).

Extra plugins for creative purposes (if I'm being honest, I just have way too much plugins).

The client must be the one that sends and submits all the files needed for the mix and / or mastering process to be done; "extra work" will be considered as "Add-ons".
